Well, apparently they don't have a zero tolerance policy. They had the 10-year old arrested for making threats with the toy gun, not just for having the toy gun.
They didn't arrest the 9-year old because apparently they only arrest once ten; they made alternative arrangements instead. (I wonder if they arrested the parent(s); the article doesn't say.)
