A hearing is set for Oct. 31 before District Judge Jeffrey Herbst. Mrs. Bach is seeking $100 in damages, plus court costs, for violation of the state's Unfair Trade Practices and Consumer Protection Law.

Did she actually expect someone from a KMart store to do anything to correct a problem? I'm afraid she's wasting her time and money. They have been sued so many times over illegal business practices and I have never heard of a customer winning. I'm afraid that many people, including judges, will miss the point and assume it's just someone who's was slightly inconvenienced and wants some money. The one thing that I have heard of that will sometimes work is filing a complaint with the BBB. Also, she could refuse to ever shop there again and tell everyone who will listen why.
