The comment is a little misleading. The actual story's message is as follows: "...authorities hadn't decided whether the boy would be charged with anything. They were reviewing the case with the state's attorney's office."
Sounds to me that they could as easily be making sure that they don't HAVE to charge the boy with something under the law. There's nothing in the story to indicate that they are inclined one way or the other.
The change of title is misleading, too. The headline on wtopnews.com is "Boy, 12, Kills Man Who Attacked His Mom". Of course, that's fair and unbiased, and we can't have that.
